Federal judge blocks Colorado's price cap on Amgen's Enbrel

A federal judge in Denver granted Amgen a preliminary injunction on July 1, 2026, blocking Colorado's Prescription Drug Affordability Review Board from capping the price of Enbrel while Amgen's lawsuit continues. The court found Amgen likely to succeed on its claim that federal patent law preempts the cap, and it also weighed the harm to Amgen's negotiations with wholesalers and other purchasers. Because the ruling is preliminary, the cap is not permanently struck down and the case is still open.

  • Ruling dated July 1, 2026, U.S. District Court for the District of Colorado, Judge Daniel D. Domenico
  • Amgen won on its patent-preemption claim, one of two claims on which it sought the injunction
  • The order blocks the state's price cap on a patented drug, not all state affordability tools
  • Case: Amgen Inc. v. Mizner, No. 1:25-cv-03452
  • A preliminary injunction is not a final judgment
